Grand Theft and Petty Theft is the unlawful acquirement of someone else’s property, with the intent to permanently deprive the owner of his/her property. “Shoplifting” is considered Petty Theft and if convicted one can serve jail time, fines and probation. The complaining witness is usually emotional when speaking to the police and exaggerates their statement. As time passes, the complaining witness calms down and usually they wish to reconcile with the defendant. Unfortunately, once the police and prosecutors become involved, it becomes irrelevant that that complaining witnesses no longer wishes to proceed with criminal action and the prosecution continues, with the defendant facing jail or even state prison time if convicted. Crime Scene Reconstruction looks at the physical evidence and attempts to determine “What happened?” and “How did it happen?” I have years of experience in putting crime scenes together, from accidents to homicides. Often times, a “witness” pieces together what they perceived happened based on what they heard, smelled, tasted, etc., and in interviewing witnesses properly, find they did not actually “see” what happened. Proper scene evaluation is detrimental to determining how and even why a crime/accident occurred. Physical evidence and photographs do not lie; “A picture is worth a thousand words”.
